26؍ نومبر آزاد بھارت کی تاریخ کا وہ یادگار دن ہے جب اسی تاریخ کو 1949میں معمارانِ قوم نے ایک نئے آئین کو اپنایا تھا۔ ملک کی آزادی سے ایک سال پہلے ہی دستور ساز اسمبلی کو یہ ذمہ داری سونپی گئی تھی کہ وہ بہت جلد آزاد ہونے والے ملک کے لیے ایک ایسا دستور مدوّن کرے جو اس ملک کے تمام طبقات کی آرزوؤں اور تمنّاؤں کی ترجمانی کرے۔ چناچہ دستو ر سازاسمبلی (Constituent Assembly)نے ڈاکٹر بھیم راؤ امبیڈکر کی قیادت میں ایک مسودہ ساز کمیٹی Drafting Committee تشکیل دی۔ اس کمیٹی نے 2سال، 11 مہینے اور 18دن کی شبانہ روز مشقت کے بعد دستور کا مسودّہ تیار کیا ۔ دستور کے اس مسودے پر کافی مباحث ہوئے اور مختلف ترمیمات کے بعد دستور اسمبلی نے 26؍ نومبر 1949کو یہ دستور منظور کرلیا۔ اسی کی یاد میں ہر سال 26؍ نومبر کو یوم دستور’یوم آئین‘ یوم قانون “کے طور پر منایا جا تا ہے۔ “یوم آ ئین “منانا کوئی بُری بات نہیں ہے۔ ملک کی عوام کو اپنے ملک کے دستور کی خصو صیات کی یاددہانی کراناچاہیے۔ بھارت کا دستور واقعی دنیا کے دیگر ممالک کے بالمقابل اپنی ایک خاص انفرادیت رکھتا ہے۔ دستور سازوں نے اس سرزمین کی مخصوص خصوصیات کو سامنے رکھتے ہوئے ایک ایسا دستور مرتب کیا جو واقعی بھارت جیسے ہمہ مذہبی، ہمہ تہذیبی اور ہمہ لسانی ملک کے تمام شہریوں کو ہر لحاظ سے مطمئن کرنے کا ذریعہ بنتا ہے۔ 26؍نومبر 1949کو جو دستور ،دستور ساز اسمبلی نے منظورکیا وہی دستور 26؍ جنوری 1950سے ملک میں نافذ العمل ہے۔ قومی رہنماؤں نے جو دستور قوم کے حوالے کیا اس کی بنیاد جمہوریت اور سیکولرازم پر ہے۔ “کثرت میں وحدت “(Unity in Diversity)ہمارے دستور کی اساس ہے۔ مذہبی رواداری اور پُر امن بقائے باہم پر بھارت ی سماج کی تشکیل عمل میں آ ئی ہے ۔ معمارانِ دستور اس حقیت سے بخوبی واقف تھے کہ یہاں صدیوں سے گنگا جمنی تہذیب پروان چڑھتی رہی ہے۔ روحانیت اور اخلاقیات اس کے خمیر میں ہے۔ اس لیے دستور سازوں نے بھارت ی سماج میں مساوات، انصاف اور بھائی چارے کی فضاء کو قائم و دائم رکھنے کے لیے ایک ایسا دستور بنایا جو تمام شہریوں کی امنگوں کی تکمیل کرتا ہے۔
آئین ہند کے دیباچہ کی حیثیت اس کی روح کے مانند ہے۔ دستور کے دیباچہ(Preamble) میں اس بات کا اعلان کیا گیا کہ “ہم بھارت کے عوام پوری متانت اور سنجیدگی سے اس بات کا عزم کرتے ہیں کہ بھارت کو ایک مقتدر، سوشلسٹ، سیکولر، عوامی جمہوریہ بنائیں گے اور اس کے شہریوں کے لیے :۔
1۔ انصاف:سماجی، معاشی اور سیاسی
2َ۔ آزادی: فکر (سوچنے) اظہار خیال، عقیدہ و عبادت
3۔مساوات:بہ اعتبار عہدہ و مواقع
4۔ اخوت : فرد کی عظمت اور قوم کے اتحاد و یکجہتی کو یقینی بنائیںگے
ہماری دستور ساز اسمبلی آج بتاریخ 26؍ نو مبر1949 دستور ہندکو وضع کرتی ہے اور اپنے آپ پرلاگو کرتی ہے۔ ”
دستور ساز اسمبلی میں استعمال کردہ ہر لفظ اپنی ایک معنویت رکھتا ہے۔ دستورسازوں نے الفاظ کا انتخاب بڑی دوراندیشی سے کیا ہے۔ دستور کے دیباچہ کا آ غاز ” ہم بھارت کے عوام “(We the people of India)سے ہوتا ہے۔ اس سے یہ بات واضح ہوجاتی ہے کہ بھارت کی عوام ہی اصل مقتدرِ اعلیٰ ہیں۔ ملک میں جو بھی حکومت بنے گی وہ عوام کی مرضی سے بنے گی۔ اسی لیے شہریوں کو رائے دہی کا حق بِلا کسی امتیاز کے دیا گیا۔ وقفے وقفے سے ہونے والے انتخابات میں رائے دہندے اپنی مرضی سے اپنے ووٹ کا استعمال کرتے ہوئے عوامی نمائندوں کو منتخب کر تے ہیں۔ جمہوریت اور سیکولرازم کو دستور میں بیان کرتے ہوئے اس کی اہمیت کو اُجاگر کیا گیا۔ ساتھ ہی ساتھ قانون کی حکمرانی کے تصور کو پیش کرکے اس بات کی ضمانت دی گئی کہ کسی شہری کے ساتھ زندگی کے کسی شعبہ میں نا انصافی نہیں کی جائے گی۔ عقیدہ اور فکر کی آزادی کے علاوہ اظہارِ خیال اور عبادت کے معاملات میں فرد کو مکمل آزادی دی گئی۔ دستور کی تمہید ہی سارے دستور کی تشریح کرتی ہے۔ اس لیے عام شہری کو دستور کی تمام دفعات کو پڑھنے اور اس کے مطابق حکومتوں سے اپنی ضرروتیں بیان کرنے کوئی واقعی حاجت نہیں ہوتی۔ بھارت کا دستور دنیا کا طویل ترین دستور ہے۔ دستور کی تدوین کے وقت یہ 395دفعات،22حصوںاور 8جدول پر مشتمل تھا۔ لیکن گزشتہ 70،72سال کے دوران ہمارے دستور میں ایک سو زائد مرتبہ ترمیمات ہوئیں اس وجہ سے بھارت ی دستور میں اب 448دفعات، 25حصے اور 12جدول ہیں۔ اتنا طویل دستور عام شہریوں کے لیے پڑھنا اور سمجھنا ناممکنات میں سے ہے۔ اس لیے دستور کے دیباچہ کو اہمیت دیتے ہوئے اُسے ملک کے تمام شہریوں کے لیے قابلِ فہم بنایاگیا۔ دستور میں شہریوں کے بنیادی حقوق کے لیے ایک پورا باب مختص کیا گیا۔ دستور کے باب سوّم میں شہریوں کے بنیادی حقوق کا تذکرہ کرتے ہوئے یہ وضاحت کردی گئی کہ یہ تمام حقوق بِلا لحاظِ مذہب، رنگ، ذات، جنس، علاقہ ، زبان و عمر تمام شہریوں کو یکساں طور پر حاصل ہیں۔ ان چھ بنیادی حقوق میں حقِ مساوات، حقِ آزادی، استحصال کے خلاف حق، مذ ہبی آزادی کا حق، تعلیمی و ثقافتی حقوق اور دستوری چارہ جوئی کا حق شامل ہے۔ یہ حقوق عام حالات میں نہ معطل کیے جاسکتے ہیں اور نہ حکومت ان کو سلب کر سکتی ہے ۔ تعلیمی اور ثقافتی حقوق دفعہ 29اور 30میں بیان کیے گئے۔ ان حقوق کا تعلق راست طورپر مذہبی اور لسانی اقلیتوں سے ہے۔ ان تمام حقوق کو دستور نے نہ صرف تسلیم کیا ہے بلکہ ان کی ضمانت دی ہے۔
اقلیتوں کے حوالے سے اگر دستورِ ہند کا جائزہ لیا جائے تو یہ بات بِلا کسی تردّد کے کہی جا سکتی ہے کہ دستور سازوں نے ملک کی اقلیتوں کے اعتماد کو بحال رکھنے اور ملک کے جمہوری نظام کو پائیدار بنائے رکھنے کے لیے اقلیتوں کی بہی خواہی کو دستوری حیثیت دینے میں اپنی فراخ دلی کا واضح ثبوت دیا۔ دستور کے مدوّن کرنے والے جانتے تھے کہ اکثریتی سماج میں اقلیتیں بے اطمینانی کا شکار ہو جائیں تو جمہوریت ہچکولے کھانے لگتی ہے۔ اسی لیے اقلیتوں کو خصوصی مراعات دیتے ہوئے انہیں زندگی کے مختلف شعبوں میں آگے بڑھنے کا موقع دیا گیا۔ انہیں اپنے تعلیمی ادارے قائم کرنے اور اس کو اپنے کنٹرول میں رکھنے کی پوری آزادی دی گئی۔ ان کی زبان، رسم الخط اور تہذیب و ثقافت کی حفاظت کو یقینی بنایا گیا۔ لیکن جیسے جیسے جمہوریت کا سفر طئے ہوتا گیا، ملک میں اقلیتوں کو دی جانے والی دستوری آزادی اور ان کے حقوق پر شب خون مارنے کے واقعات سامنے آ نے لگے۔ آج جب کہ حکمران ملک کے دستور کی دہائی دیتے ہیں ۔ انہیں پہلے خود اپنا محاسبہ کرنا چاہیے کہ انہوں نے ملک کے دستور کا کتنا پاس و لحاظ رکھا۔ انہوں نے اپنی غلط حکمرانی کے ذریعہ اس کی
دھجیا ںاڑادیں۔
آج آئین اپنی بے زبانی سے دنیا کو یہ پیغام دے رہا کہ ملک کے حکمرانوں نے ملک کے دستور کو محض ایک کھلونا بنا کر اسے اپنے مفادات کی تکمیل کا زینہ بنایا۔ ” یومِ دستور”کا جشن منانے والے یہ بھول گئے کہ دستور کے بنانے والوں نے جن خوابوں کو لے کر اس دستور کی تدوین کی تھی ، وہ خواب آخر کب شرمندہ تعبیر ہوں گے۔ دستور، محض الفاظ کا خوبصورت پیرہن نہیں ہوتا کہ جس کو یوم ِ جمہوریہ یا یوم ِ آئین کے موقع پردہرادیا جائے۔ یومِ دستور کے دن کو یوم احتساب مانتے ہوئے ہمیں جائزہ لینا چاہیے کہ کیا واقعی ہم دستور کے تقا ضوں کو پورا کرنے میں کامیاب ہوئے ہیں؟ کیا ہماری حکومتیں اپنے شہریوں کے ساتھ انصاف اور مساوات کے پیمانوں کو پورا کررہی ہیں؟ ایک جمہوری اور سیکولر دستور کے ہوتے ہوئے ملک میں جارحانہ فرقہ پرستی کیوں بڑھتی جارہی ہے؟ کیا یہ حقیقت نہیں ہے کہ ملک کے خاص طبقوں کے ساتھ تعصب اور جانبداری برتی جا رہی ہے۔ ایسے ہی گوناگوں سوالات ہیں جو یوم آئین مناتے ہوئے شہریوں کے ذہن میں گردش کر رہے ہیں۔ اربابِ اقتدار نے کبھی ان چبھتے ہوئے سوالات کا کوئی جواب تلاش کیا ہے۔ ملک کے عظیم سپوتوں نے جن امیدوں کے ساتھ اس دستور کی تدوین کی تھی وہ ساری امیدیں سراب ثابت ہورہی ہیں۔ دستور کے نفاذ کے 72 سال بعد بھی ہم دستورِہند کے بنیادی اصولوں کی تکمیل کرنے سے قاصر ہیں۔ یہی وجہ ہے کہ جب دستورِ ہند کی گولڈن جوبلی منائی جارہی تھی اس موقع پر پارلیمنٹ کے خصوصی اجلاس سے خطاب کرتے ہوئے بھارت کے اُس وقت کے صدر جمہوریہ کے۔ آر نارائنن نے دوٹوک انداز میں کہا تھا کہ “آج ہم یہ دیکھیں کہ آیا دستور ناکام ہوا ہے یا ہم نے دستور کو ناکام کر دیا ہے” آنجہانی کے۔ آر۔نارائنن نے جن اندیشوں کا اظہار دو دہے قبل کر دیا تھا ، اُ سے آج بھارت ی قوم کھلی آنکھوں سے دیکھ رہی ہے۔ دستور کی پامالی جس انداز میں اس وقت ہورہی ہے اس سے ملک کی جمہوریت اور اس کا سیکولر کردار داؤ پر لگ گیا ہے۔ قانون کی حکمرانی محض ایک نعرہ بن کر رہ گئی ہے۔ دستوری اداروں پر حکومت کی گرفت اس قدر بڑھ گئی ہے کہ کوئی ادارہ شفافیت اور غیر جانبداری کے ساتھ کام نہیں کر سکتا۔ اقلیتوں کے حقوق اور ان کی آزادیاں حکومت کے رحم و کرم پر ہوگئی ہیں۔شہریوں کی اظہارِ خیال کی آزادی ختم کردی گئی۔ دستور کی روح کو ختم کرکے نمائشی طور پر یومِ آئین کا مناناآئین کا مذاق اڑانے کے مترادف ہے۔ اس سے جمہوریت اور سیکولرازم کو کوئی استحکام ملنے والا نہیں۔ اس وقت ملک میں جس پارٹی کی حکومت ہے اس نے بے رحم حکمرانی کے اصول کو اپنا لیاہے۔ حکومت کی پالیسیوں سے اختلاف رکھنے والوںکو کچل دینا ہی اس کی پالیسی بن چکی ہے۔ آج ملک کی جو کچھ صورت حال ہے اس پر سب ہی انصاف پسند حلقے تشویش کا اظہار کررہے ہیں۔ آئین کے فلسفیانہ اصولوں کوپسِ پشت ڈال دیا گیا ہے۔ آئینی جمہوریت کا تصور ناپید ہو گیا۔ بھارت کے آئین نے سیکولر طرز حکمرانی کے جو اصول مرتب کیے تھے اب ان کو روبہ عمل لانے کے بارے میں حکومت کوئی ٹھوس اقدامات کر تی ہوئی نظر نہیں آ رہی ہے۔ ایک نو آزاد ملک میں سماج کے تمام طبقوں کے حقوق اور ان کی آزادیوں کو دستور کی مختلف دفعات کے ذریعہ محفوظ کر دیا گیا تھا، اب اس کا کوئی پاس و لحاظ نہیں رکھا جا رہا ہے۔ خاص طور پر اقلیتیں حاشیہ پر لادی گئیں ہیں۔ ان کے جائز مطالبات کو بھی حکومت قبول کرنے سے گریز کر رہی ہے۔ قانون کی حکمرانی، آئین کی پاسداری اور سیکولر قدروں کا تحفظ اب قصہ پارینہ بنتا جا رہا ہے۔ ایسی صورت حال میں عوام کی چوکسی ہی ملک کے آئین کی حفاظت کر سکتی ہے اور اسی کے ذریعہ ملکی ترقی اور سماج میں اتحاد و اتفاق کاخواب پوراہوسکتا ہے۔ضرورت ہے کہ بھارت کے آئین کے مطابق اس ملک کو چلایا جائے۔

HYDERABAD: Amazon Web Services (AWS) is planning to invest an estimated $4.4 billion (Rs 36,300 crore) in India by 2030 through the new AWS Asia Pacific (Hyderabad) Region. The construction and operation of the AWS Asia Pacific (Hyderabad) Region is estimated to add approximately $7.6 billion to India’s gross domestic product (GDP) by 2030.

The investment includes capital expenditure on the construction of data centres, operational expenses related to ongoing utilities and facility costs, and purchases of goods and services from regional businesses. 

The investment is also estimated to support more than 48,000 full-time jobs annually at external businesses during this time. These jobs will be part of the AWS supply chain in India, including construction, facility maintenance, engineering, telecommunications, and jobs within the country’s broader economy.

On Tuesday, AWS launched its second AWS Infrastructure Region in India, the AWS Asia Pacific (Hyderabad) Region, wherein developers, startups, entrepreneurs, and enterprises, as well as government, education, and nonprofit organisations, will have greater choice for running their applications and serving end-users from data centres located in India. 

“We welcome AWS’s commitment to invest approximately Rs 36,300 crore in the AWS Region in Hyderabad, which strengthens Telangana’s position as a progressive data centre hub in India,” said IT & Industries Minister KT Rama Rao.

“We recognise the power of cloud computing, which is why we have collaborated with AWS to improve e-governance, healthcare, and municipal operations to benefit the citizens of Telangana. We are pleased that the new AWS Region in Hyderabad will spur more innovation and growth for many enterprises, startups, and public sector organisations in India,” he added. 

With its launch, AWS now has 96 Availability Zones across 30 geographic regions, with announced plans to launch 15 more Availability Zones.

Customers will have access to advanced AWS technologies to drive innovation including storage, data analytics, security, machine learning, and artificial intelligence (AI).
